Bitcoin India mein kab aaya? Short answer: Bitcoin reached India through a handful of enthusiasts around 2012, and India's first Bitcoin platform, Unocoin, started in Bangalore in 2013. Uske baad ka safar seedha nahi tha: RBI warnings from 2013, a banking cut-off in 2018, a Supreme Court win in 2020, a 30% tax and 1% TDS from 2022, anti-money-laundering rules in 2023, and transaction reporting from 2026.
Today, Bitcoin is not banned in India. It is taxed, it is unregulated as an asset, and platforms must register with FIU-IND under anti-money-laundering law. I was in Bangalore at the start and I co-founded Unocoin, so let me tell it year by year.
2012 to 2013: meetups and the first exchange
Around 2011 and 2012 I was living in Bangalore, selling robots for a Canadian robotics company. I came across the Bitcoin white paper and could not put it down.
In Toronto, Bitcoin people met regularly. In Bangalore, nobody did. So I started India's first Bitcoin meetups. Coffee shops at first, then bigger rooms. By my count I ran more than a hundred of them.
Every meetup ended with the same question: Bitcoin kaise kharidein? How do I buy it? The honest answer was awkward. I had to send people to Mt. Gox in Japan or to a young company in the US called Coinbase. Nothing was built for an Indian buyer.
The meetups grew into a conference at the Sheraton in Bangalore in 2013, and Unocoin launched there. The company started in December 2013. That is the moment I would point to if you ask when Bitcoin became something an ordinary Indian could buy in rupees.
2013 onward: RBI caution notices
The RBI noticed quickly. From 2013 it issued cautionary press notes warning the public about virtual currencies. As I remember it, the first came a couple of weeks after our launch, and similar warnings followed in later years.
Ek baat yaad rakhiye: a caution notice is not a ban. There was no law against Bitcoin. The RBI was telling people to be careful, which is fair advice for anything new.
The tax department noticed too. On the third day of our business, with two employees, I remember about thirty people from the tax department arriving at our office. From day one, we decided we would never run from the government. We would deal with them.
2018: the banking cut-off
On 6 April 2018 the RBI issued a circular, "Prohibition on dealing in Virtual Currencies". It told banks and other RBI-regulated entities not to deal in virtual currencies or serve anyone who did, and to exit existing relationships within three months.
For exchanges, that meant no bank accounts. No rupees in, no rupees out. At Unocoin we laid off around a hundred people just to survive. Kuch companies ne India chhod diya. We stayed and went to court. Our Supreme Court page has the detail.
2020: the Supreme Court
On 4 March 2020, in Internet and Mobile Association of India v. Reserve Bank of India, a three-judge bench of the Supreme Court set the circular aside. The judgment, delivered by Justice V. Ramasubramanian, accepted that the RBI has power to regulate in this area but found this measure disproportionate. Unocoin was part of the case that challenged the ban.
The judgment did not make Bitcoin official money and did not create a regulator. It reopened the banking door. In May 2021, the RBI told banks they could no longer cite the 2018 circular, while normal KYC and anti-money-laundering checks continue.
2022: the tax rules
The Finance Act 2022 brought in the tax framework most people know today. It inserted three provisions into the Income-tax Act, 1961:
- Section 115BBH: income from transferring a virtual digital asset is taxed at a flat 30%, plus surcharge and cess. Only the cost of acquisition is deductible. Losses cannot be set off against other income or carried forward.
- Section 194S: 1% TDS on the consideration paid for a VDA transfer, from July 2022, subject to thresholds.
- Section 2(47A): the definition of a virtual digital asset.
People often ask, "Bitcoin par tax lagta hai to legal hai na?" Tax does not mean approval. It means the government wants its share and wants a record. Our India crypto tax guide covers how it works.
2023: PMLA and FIU-IND
On 7 March 2023, the Ministry of Finance notification S.O. 1072(E) brought five VDA activities under the Prevention of Money Laundering Act:
- exchange between VDAs and rupees or other fiat money
- exchange between one VDA and another
- transfer of VDAs
- safekeeping or administration of VDAs
- financial services for an issuer's offer and sale of a VDA
Any business doing these for others became a reporting entity, required to register with FIU-IND, verify customers, keep records and report suspicious transactions. Unocoin is registered with FIU-IND as a reporting entity under the PMLA.
2026: reporting and the debate
Three things defined 2026 so far.
First, the Income-tax Act, 2025 took effect on 1 April 2026, renumbering sections. The 30% tax and 1% TDS carry over in substance.
Second, reporting. Under section 509 of the new Act and Rules 241 to 244, CBDT guidance reported on 27 July 2026 set out how platforms report under the OECD's Crypto-Asset Reporting Framework. From calendar year 2026, platforms report transactions in rupees in Form 167, due by 31 May of the following year. No new tax for users, but your return should match what platforms report.
Third, the debate in Parliament. In July 2026, the RBI told the Standing Committee on Finance that VDAs should not be legalised, while ICAI argued for a comprehensive VDA law. By 17 September 2026 the committee had concluded its discussions on VDAs and was awaiting the government's response. India still has no standalone crypto law.
To Bitcoin India mein legal hai?
Yeh sawaal sabse zyada poocha jata hai, to seedha jawab. Bitcoin kharidna, rakhna aur bechna India mein banned nahi hai. Supreme Court ne March 2020 mein RBI ka banking cut-off hata diya tha. Uske baad se crypto par tax lagta hai, aur platforms ko FIU-IND ke saath register karna padta hai.
Lekin "legal" ka matlab "regulated" nahi hai. India mein crypto ke liye abhi koi alag law nahi hai, aur crypto products unregulated hain. Isliye agar kuch galat ho jaye, to regulatory recourse shayad na mile. Courts ne bhi apna nazariya diya hai: October 2025 mein Madras High Court ne ek interim order mein kaha ki crypto property hai, jise rakha ja sakta hai aur trust mein hold kiya ja sakta hai, lekin yeh currency nahi hai.
Mera simple formula: registered platform use kijiye, har sale ITR mein dikhaiye, apni OTP aur seed phrase kabhi kisi ko mat dijiye, aur utna hi lagaiye jitna aap kho sakte hain.
What thirteen years look like from here
When I started those meetups, the question was "Bitcoin kya hai?" Then it became "kaise kharidein?" Then "kya yeh ban hai?" Today the most common question I hear is about tax. That is a sign of how far Indian Bitcoin has come: people are not asking whether it exists anymore, they are asking how to hold it properly.
